Delaware roofing: permits, codes and approvals

County and city building permits, the state contractor business license and gross receipts tax, the 3-day door-to-door cancellation rule, and Delaware mechanics' lien deadlines with protection for owner-occupied homes.

1 · Product approvals

Product approvals

Delaware has no state roofing product approval or listing system. Local code officials rely on the code's labeling requirements and evaluation reports such as ICC-ES.

2 · Permit forms

City re-roof permits

Delaware has no statewide re-roof permit rule. The three counties and the incorporated cities run their own permit offices; check the jurisdiction where the house sits.

3 · Code rules

Code rules

No statewide residential building code was confirmed; counties and cities adopt their own editions. Sussex County requires the 2024 IECC for new homes from April 11, 2027. Official adoption page ↗

5 · License and insurance

License and insurance

Delaware has no roofing trade license, but every contractor, resident or not, needs a state contractor business license from the Division of Revenue and pays a gross receipts tax.

6 · Lien and contract forms

Lien and contract rules

A contractor hired by the owner files a lien within 180 days of completion; subs and suppliers within 120 days. Owner-occupied homes paid in full in good faith are protected, and advance lien waivers are void.
